Welcome to FRAGRANCE DEALS (“we”, “us”, “our”). By accessing www.fragrancedeals.com and/or purchasing our products, you agree to be bound by these Terms & Conditions. Please read them carefully before using our services.

2. Definitions

 

 

  • Consumer: A natural person who is not acting for purposes relating to trade, business, craft, or profession and enters into a distance contract with the entrepreneur.

  • Cooling-off Period: The period during which the Consumer can exercise the right of withdrawal.

  • Day: Calendar day.

  • Durable Medium: Any tool enabling the Consumer or entrepreneur to store information addressed personally to them in a way that future consultation and unaltered reproduction is possible (e.g., email).

  • Distance Contract: A contract concluded between the entrepreneur and the Consumer within an organized distance sales scheme without the simultaneous physical presence of the entrepreneur and the Consumer, with exclusive use of one or more means of distance communication.

 

 

 

 

3. Applicability

 


These Terms & Conditions apply to every offer made by FRAGRANCE DEALS and every Distance Contract concluded between FRAGRANCE DEALS and the Consumer.

 

 

 

4. The Offer

 

 

  • If an offer has a limited validity period or is made subject to conditions, this will be explicitly stated.

  • Product descriptions are complete and accurate to allow a proper assessment by the Consumer. Obvious mistakes or errors (including typographical or pricing errors) do not bind us.

 

 

 

 

5. The Contract

 

 

  • The contract is concluded when the Consumer accepts the offer and meets the corresponding conditions.

  • If the Consumer has accepted the offer electronically, FRAGRANCE DEALS will promptly acknowledge receipt of the acceptance electronically.

  • We reserve the right to refuse an order (e.g., due to suspected fraud, payment issues, or stock unavailability). If payment has been made, we will refund it without undue delay.

 

 

 

 

6. Right of Withdrawal (14 Days)

 

 

  • The Consumer may dissolve the contract regarding the purchase of a product within 14 days without stating reasons.

  • The Cooling-off Period starts on the day after the Consumer, or a third party indicated by the Consumer (not being the carrier), has received the product.

  • To exercise the right of withdrawal, the Consumer must notify us within the Cooling-off Period via an unambiguous statement (e.g., email to support@fragrancedeals.com).

 

 

 

 

7. Consumer’s Obligations During the Cooling-off Period

 

 

  • During the Cooling-off Period, the Consumer shall handle the product and packaging with care.

  • Perfumes, cosmetics, skincare and other hygiene-sensitive products may only be returned if they are unopened, unused, and in the original sealed packaging (cellophane/brand seal intact).

  • The Consumer may only open or handle the product to the extent necessary to determine its nature and characteristics. The Consumer is liable for any diminished value resulting from handling beyond what is necessary.

 

 

 

 

8. Exercise of the Right of Withdrawal & Return Costs

 

 

  • After notifying withdrawal, the Consumer returns the product within 14 days.

  • Returns must include all accessories and be sent back in original condition and packaging according to our return instructions.

  • The Consumer bears the direct costs of returning the product, unless the product is defective or incorrectly delivered.

  • The risk and burden of proof for the correct and timely exercise of the right of withdrawal lie with the Consumer (use a trackable service).

 

 

 

 

9. Our Obligations in Case of Withdrawal

 

 

  • If withdrawal is notified electronically, we will send an acknowledgement of receipt without delay.

  • We will reimburse all payments received from the Consumer, including standard delivery costs (if any) for the returned product, without undue delay and within 14 days from the day we are informed of the Consumer’s decision to withdraw.

  • We may withhold reimbursement until we have received the goods back or the Consumer has supplied evidence of having sent back the goods, whichever is the earliest.

  • Refunds are made using the same means of payment used for the initial transaction, unless otherwise agreed.

 

 

 

 

10. Exclusions to the Right of Withdrawal

 


Provided this was clearly stated prior to purchase, the following items are excluded:

 

  • Sealed goods not suitable for return due to health protection or hygiene reasons that were unsealed after delivery (e.g., opened perfumes, cosmetics, skincare).

  • Goods made to the Consumer’s specifications or clearly personalized.

  • Goods marked as “final sale”.

  • Gift cards/vouchers.

 

 

 

 

11. Prices & Promotions

 

 

  • Prices shown include VAT where applicable.

  • During the validity period stated in the offer, prices will not be increased, except due to VAT changes or manifest errors.

  • Promotions, coupons, and discounts are subject to their specific terms and cannot be combined unless explicitly stated.

 

 

 

 

12. Compliance & Warranty

 

 

  • FRAGRANCE DEALS guarantees that products comply with the contract, product specifications, and applicable legal requirements at the time of delivery.

  • If a product is delivered damaged or defective, contact support@fragrancedeals.com promptly with photos and your order number. Statutory rights apply.

 

 

 

 

13. Delivery, Risk & Execution

 

 

  • We take the greatest possible care when receiving and executing orders.

  • Delivery address is the address provided by the Consumer.

  • We aim to dispatch accepted orders promptly and no later than 30 days, unless otherwise agreed. In case of delay or inability to fulfil, we will notify the Consumer within 30 days; the Consumer may then dissolve the contract at no cost.

  • Risk of loss passes to the Consumer upon delivery to the indicated address.

 

 

 

 

14. Payment

 

 

  • Unless otherwise agreed, amounts due are paid at checkout via the offered payment methods.

  • The Consumer must promptly report inaccuracies in provided or stated payment details.

  • We may carry out pre-authorization checks and decline transactions at our discretion (refund will follow if already charged).

 

 

 

 

15. Returns & Exchanges (Operational Rules)

 

 

  • Returns: only unopened, unused, in original sealed packaging.

  • Exchanges: possible subject to stock, provided the item is in original sealed condition.

  • Original shipping costs are non-refundable (unless the item was defective or mis-shipped).

 

 

 

 

16. Complaints Procedure

 

 

  • Complaints about contract performance must be submitted fully and clearly described to support@fragrancedeals.com within a reasonable time after discovery.

  • We reply within 14 days from receipt. If more time is needed, you will receive a confirmation and an indicative timeline.

  • You may also use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.

 

 

 

 

17. Liability

 

 

  • We are not liable for indirect, incidental, or consequential damages, unless caused by intent or gross negligence.

  • Our total liability for direct damages shall not exceed the purchase price of the product giving rise to the claim, unless mandatory law dictates otherwise.

  • Nothing in these Terms limits liability for death or personal injury resulting from negligence, fraud, or fraudulent misrepresentation.

 

 

 

 

18. Force Majeure

 

 

  • We are not responsible for any failure or delay due to events beyond our reasonable control, including but not limited to natural disasters, strikes, pandemics, supply chain disruptions, carrier delays, or governmental actions.

 

 

 

 

19. Retention of Title

 

 

  • Delivered products remain our property until all amounts owed by the Consumer under the contract have been paid in full.

 

 

 

 

20. Intellectual Property

 

 

  • All content on www.fragrancedeals.com (text, images, logos, trademarks) is protected. Use requires prior written permission from FRAGRANCE DEALS or the applicable rights holder.

 

 

 

 

21. Personal Data

 

 

  • We process personal data in accordance with GDPR. Please refer to our Privacy Policy for details on data collection, processing, and your rights.

 

 

 

 

22. Governing Law & Jurisdiction

 

 

  • These Terms & Conditions and any contracts between FRAGRANCE DEALS and the Consumer are governed exclusively by Dutch law.

  • Disputes shall be submitted to the competent Dutch court, without prejudice to mandatory consumer protection provisions.

 

 

 

 

23. Changes to These Terms

 

 

  • We may amend these Terms from time to time. The version applicable to your purchase is the version in force at the time you placed your order. The latest version will always be available on our website.
